A 36-year-old Pound man was charged June 25 in Oconto County with attempted first-degree intentional homicide and three counts of first-degree recklessly endangering safety.
Judge Michael Judge set a $500,000 cash bond and adjourned the initial appearance until July 16 for Cody K. Race.
According to the criminal complaint, at about 12:50 a.m. June 18, deputies responded to a report of a shooting on Tom Post Road in the Town of Brazeau.
The victim, and adult male, suffered a gunshot wound to his upper left leg. Bleeding was being controlled by an improvised tourniquet. Deputies determined the shooting was intentional, not accidental as originally reported.
The gunshot victim was taken to St. Vincent Hospital in Green Bay.
An assault rifle with blood stains was found by deputies as well as a fired 5.56mm cartridge casing, both on the residence side porch. They also found a 5.56mm coupled rifle magazine in the residence as well as drug paraphernalia in an outbuilding on the property.
According to the complaint, Race armed himself with a semi-automatic assault rifle and confronted two men and a woman outside the residence, demanding information as to the whereabouts of his girlfriend. He reportedly operated controls on the rifle producing audible noise in which it was believed Race was charging a round into the chamber of the rifle. Race pointed the rifle specifically at the three people, following threats to kill them.
One of the men attempted to persuade Race to stop. He instructed Race to put the rifle down, and he approached Race on foot with his arms up in an effort to de-escalate the situation.
As the man walked closer to the porch, Race shot him once with the rifle, striking the man’s upper left leg.
The female witness attempted to render aid to the victim and called 911 to report an accidental shooting. She told deputies later she said the shooting was accidental because Race was close by and he allegedly threatened to kill her if she told the truth during her emergency call.
Race faces up to 60 years in prison on the attempted homicide charge, and up to $25,000, 12 years and six months in prison or both on each of the other felony charges.
The adjourned initial appearance will continue at 11:30 a.m. July 16 in front of Judge Jay Conley.
