A Portage man who was granted a retrial after serving two years of a sentence for repeated sexual assault of the same child was sentenced to time served March 25.
Joshua L. Dickinson, 47, Portage, pleaded no contest Feb. 24 to an amended charge of causing mental harm to a child rather than risk being convicted a second time at a trial that had been scheduled for Jan. 23.
An Oconto County jury found Joshua L. Dickinson, 46, guilty after a two-day trial in November 2021, and Judge Michael Judge sentenced him to six years in prison followed by five years of extended supervision with conditions.
Dickinson later filed a motion for a retrial on grounds that three Child Protective Services (CPS) reports were never introduced by either the prosecution or defense.
Judge ruled in March 2024 that the CPS reports did contain material information and that the defendant was prejudiced by the failure of both sides’ attorneys to provide them in discovery. As a result, Judge set aside the jury verdict and ordered a new trial.
During Dickinson’s appearance March 25, Judge sentenced him to 12 months in the county jail but deemed that time served.
