A Bonduel man scheduled for arraignment Tuesday on a drunken driving charge in Waupaca County was arrested Monday night for allegedly driving drunk in Shawano County.
Kevin D. Moericke, 36, was pulled over by a Shawano County sheriff’s deputy shortly before midnight after he was allegedly spotted doing 71 mph on state Highway 47 in the town of Lessor. The posted speed limit there is 55 mph.
Moericke was out on a $2,000 signature bond in the Waupaca County case. The conditions of the bond included absolute sobriety. He was also forbidden from operating a motor vehicle.
According to the criminal complaint, a preliminary breath test when he was pulled over Monday showed an alcohol concentration of .04 percent. Two empty beer cans were found in his vehicle, according to the complaint.
Moericke was also charged with two felony counts of bail jumping and a misdemeanor count of operating a vehicle after having had his license revoked.
He could face a maximum six years in prison and $10,000 fine for fifth or sixth offense operating while intoxicated and the same possible penalty on each of the two felony bail jumping counts.
A cash bond of $500 was set at an appearance in Shawano-Menominee County Circuit Court on Tuesday. A preliminary hearing was scheduled for Thursday.
According to court records, Moericke had three previous OWI convictions in Shawano County and one in Waupaca County; all of them misdemeanors.
His last conviction in Shawano County in 2008, while riding a motorcycle, included two misdemeanor charges of causing injury while operating under the influence, according to court records.
Moericke was sentenced by Judge Thomas Grover to 270 days in jail.
The pending Waupaca County case stems from his arrest for allegedly driving drunk on April 13.
