The trial of a rural Shawano man accused of killing his former mistress and her brother has been postponed. The trial of Daniel Lee Schmidt, 30, scheduled to start on Monday will be delayed until Oct. 14, due to a change in prosecutors.
Schmidt is accused of two counts of first-degree intentional homicide for the shotgun slayings of Kimberly Rose, 32, and Leonard Marsh, 22.
Assistant Attorney General Richard Dufour has been assigned to the case as a special prosecutor, replacing Assistant Attorney General David Wambach, who was appointed judge for the Jefferson County Branch III Circuit Court. The schedule change was arranged at a status conference Monday with Judge Michael Judge in Oconto County Court.
Jury selection is scheduled Friday, Oct. 11, with the trial to take place the following week.
Schmidt, in November, pleaded not guilty to the homicides. He was arrested on Sept. 4 for the shootings, which occurred in May 2009 at the home that Rose and Marsh shared in the town of Gillett.
According to testimony at the preliminary hearing Oct. 3, Schmidt allegedly initiated an affair with Rose in November 2008, but later tried to end the relationship and repair his marriage.
Schmidt’s wife, Stephanie, said Rose loaned Schmidt $1,000 to purchase a motorcycle and then pressured him to repay the loan.
Part of the loan was repaid with marijuana, Stephanie Schmidt testified. Marijuana was the subject of numerous arguments between Schmidt and Rose, according to the testimony.
If convicted, Schmidt faces a maximum penalty of life in prison. He is being held on $2 million bond.
