Proceedings of Nov. 22

• A three-day jury trial starting Nov. 28 was postponed to May 8 for an Oconto Falls man charged with a charge of homicide by the intoxicated use of a motor vehicle. Thomas Edward Wolf, 56, is charged in connection with a crash Aug. 3 that claimed the life of Bart Erdman, 60, also of Oconto Falls. Judge Michael Judge scheduled a motion hearing for March 7.

• Crystal Lynn Peterson, 48, Marinette, was sentenced to two years and six months in prison, followed by three years of extended supervision, for possession of cocaine with intent to deliver, in connection with an incident that occurred May 19, 2022. Judge gave Peterson credit for five days already served.

• James P. Linz, 40, Oconto, waived his right to a preliminary hearing and pleaded not guilty to possession of methamphetamine and misdemeanor possession of drug paraphernalia, in connection with an incident that allegedly occurred Nov. 4. Judge scheduled a pre-trial conference for Jan. 11.

• After a preliminary hearing, Tarah Lea Swope, 42, Appleton, was bound over on two counts of physical abuse of an elderly person and misdemeanor counts of criminal damage to property and disorderly conduct, in connection with an incident that allegedly occurred Sept. 25. Bond was set at $5,000 cash after she was charged with felony bail jumping, in connection with an incident that allegedly occurred Sept. 29. Arraignment was scheduled for Dec. 14.

• Christopher Harvey Belland, 45, Bonduel, waived his right to a preliminary hearing and was bound over on charges of theft by false representation, two counts of issuing worthless checks, two counts of felony bail jumping, and one count of misdemeanor bail jumping, in connection with an incident that allegedly occurred June 2, as well as theft by false representation, issuance of worthless checks greater than $2,500, two counts of felony bail jumping, and misdemeanor counts of issuance of worthless checks less than $2,500 and bail jumping, in connection with an incident that allegedly occurred Aug. 17. Judge Jay Conley scheduled arraignment for Dec. 14.

• Bond was set at $5,000 cash for Kenneth L. Behnke Jr., 45, Oconto Falls, after he was charged with third-degree sexual assault, substantial battery intending bodily harm, and misdemeanor disorderly conduct, in connection with an incident that allegedly occurred Nov. 21. Conley adjourned his initial appearance until Dec. 14.

• Bond was set at $500 cash for Jacqueline Rochelle Cyburt, 26, Inglston, Michigan, after she was charged with second-degree recklessly endangering safety and misdemeanor battery and disorderly conduct, in connection with an incident that allegedly occurred Nov. 17. Conley adjourned her initial appearance to Dec. 14.

Proceedings of Nov. 21

• Michael A. Holtger, 31, Oconto, was sentenced to one year in the county jail for felony bail jumping and a misdemeanor count of resisting or obstructing an officer, in connection with an incident that occurred Oct. 14, 2022. Judge scheduled a Dec. 1 status conference to determine how the number of days Holtger should be credited for time served.

• Justin James Huncosky, 19, Suring, pleaded guilty to third-degree sexual assault of a child and a misdemeanor count of exposing himself to a child, in connection with an incident that occurred Feb. 1. The felony charge was amended from second-degree sexual assault of a child in a plea agreement. Conley scheduled sentencing for Jan. 29 and ordered a pre-sentence investigation.

• Paige N. Klivickis, 30, Oconto, pleaded guilty to possession of methamphetamine, in connection with an incident that occurred Jan. 20, 2022. Conley scheduled sentencing for Feb. 1 and ordered a pre-sentence investigation.

• Marty M LaCourt, 34, Oconto, waived his right to a preliminary hearing and pleaded not guilty to second-degree sexual assault of an intoxicated victim, in connection with an incident that allegedly occurred Aug. 5. Judge scheduled a pre-trial conference for Jan. 11.

Proceedings of Nov. 20

• Shannon R. Tuchscherer, 50, Gillett, was sentenced to two years in prison, followed by three years of extended supervision, for theft in a business setting, in connection with a series of thefts that occurred over several years while Tuscherer was bookkeeper for Sunshine Daycare in Gillett. Conley determined that she owes restitution of $125,652 and assessed surcharges of another $20,024, which must be paid in monthly installments starting after she is released from prison in 2025.

• Joshua Joe Bacon, 19, Oconto, was sentenced to one year in prison, followed by two years of extended supervision, for strangulation and suffocation, felony bail jumping and misdemeanor charges of battery, two counts of disorderly conduct, and criminal damage to property, in connection with incidents that occurred Feb. 1, Feb. 17,-18. Judge ruled that the sentence is to be served consecutive to a prison sentence in a Marathon County case.

• A final pre-trial conference was held for the Dec. 4-5 jury trial of Gerald W. Tucker III, 54, Lakewood. He is charged with possession of a firearm by a person convicted of a felony, and misdemeanor counts of battery, carrying a concealed weapon, possession of THC, disorderly conduct, and possession of drug paraphernalia, in connection with an incident that allegedly occurred Aug. 8, 2020.

• A Dec. 5-6 jury trial was postponed for Charles S. Elm, 49, De Pere, on charges of possession of THC (second or subsequent offense), felony bail jumping, and misdemeanor counts of bail jumping, possession of drug paraphernalia, and operating a motor vehicle while his license was revoked, in connection with an incident that allegedly occurred Dec. 30. Judge set a status conference for Jan. 11.

• Bond was set at $1,000 cash for Cindy M. Earley, 55, Oconto, after she was charged with felony bail jumping and misdemeanor charges of resisting or obstructing an officer and disorderly conduct, in connection with an incident that allegedly occurred Sept. 29. Judge adjourned her initial appearance until Jan. 11. Meanwhile, Earley’s Dec. 5 jury trial was canceled, on a felony charge of child abuse intentionally causing harm and misdemeanor counts of bail jumping and disorderly conduct, in connection with an incident that allegedly occurred June 23. A status conference on the earlier charges was also scheduled for Jan. 11.

• Bond was set at $1,000 cash for Sara Lee Ducat, 35, Oconto, after she was charged with battery or threat to a law officer, misdemeanor disorderly conduct, in connection with an incident that allegedly occurred Nov. 19. Conley adjourned her initial appearance to Dec. 14.

• A $1,000 signature bond was set for James P. Samuelson, 52, Suring, after he was charged with possession of methamphetamine and misdemeanor possession of drug paraphernalia, in connection with an incident that allegedly occurred Nov. 17. Conley adjourned his initial appearance to Dec. 14.
