New trial scheduled in child assault case

An Oconto County judge has ordered a new trial for a man charged with multiple counts of child sexual assault.

Judge Michael T. Judge declared a mistrial April 20 midway through the second day of testimony in the case of David J. SanRoman, 46, Oconto. SanRoman is charged with four counts of first-degree child sexual assault and one count of second-degree child sexual assault, all counts charged as a persistent repeater, in connection with incidents that allegedly occurred from 2016 to 2020.

The mistrial was declared after a witness referred in her testimony to a report that the defense attorney believed he had not received during the discovery process. During a status conference on April 29, Judge listened to explanations from both sides and ruled that holding a new trial was appropriate.

The retrial is scheduled for June 29-30. A final pre-trial conference was set for June 15.
