Boy, 16, charged with attempted homicide

Marion police say he will be charged as an adult

A 16-year-old Marion boy has been charged with attempted first degree homicide, attempted first degree homicide (unborn child), strangulation, false imprisonment and intimidation of a witness-use of force.

At 12:09 p.m. Tuesday, the Marion Police Department was dispatched to a residence for an after-the-fact report of an assault that occurred earlier in the day.

Through investigation, it was determined that Kevin M. Herzog, 16, got into an argument with his pregnant 17-year-old girlfriend. Herzog allegedly would not let his girlfriend leave the property and had her remove her shoes to help prevent her from leaving. He also took his girlfriend’s phone from her so she could not contact anyone.

Herzog then strangled her and punched her in the stomach, according to the Marion Police Department.

The girl was able to escape and get to a relative’s residence, where the police were notified of the incident. Herzog was taken into custody and the girl was taken to the hospital.

Herzog will be waived into adult court for the charges, according to a Marion police department statement.

Herzog had his initial appearance in Waupaca County Circuit Court on Thursday.

The Marion Police Department was assisted by the Clintonville Police Department and the Waupaca County Sheriff’s Department.
